Terms of Service
Last updated November 6, 2026
The short version: BackIn60 texts back your missed callers and gives you an inbox to reply. You get 14 days free, then it's $497/month, billed on our website, cancel anytime. You agree to use it only to reply to people who contacted your business, and to follow texting laws. These terms are a legal agreement, so please read them.
1. The agreement
These Terms are between you and BackIn60, operated by Christeven Donegan, a sole proprietor based in Staten Island, New York (“BackIn60,” “we,” “us”). By creating an account, starting a trial or using the BackIn60 website, web dashboard or app, you agree to these Terms and to our Privacy Policy and SMS Terms. If you're signing up for a business, you confirm you're allowed to bind that business, and “you” means the business. You must be at least 18 and BackIn60 is for businesses, not personal use.
2. The service
BackIn60 gives your business a BackIn60 phone number. When you set your business line to forward unanswered calls to it, BackIn60 sends the caller an automatic text, usually within 60 seconds, and shows the call and any replies in your inbox so you can respond. It includes a booking link in texts if you add one, opt-out handling, and basic stats. We aim for 60 seconds, but delivery times depend on phone carriers and aren't guaranteed. Features marked “coming soon” aren't part of the service until they launch. We may improve or change features over time.
3. Your account
Keep your sign-in email secure and your account details accurate. You're responsible for what happens under your account, including what your staff send. Tell us right away if you think someone has accessed it without permission.
4. Free trial
New customers get a 14-day free trial. A payment card is required to start the trial. When the trial ends, your subscription starts automatically and your card is charged $497/month unless you cancel before the trial ends. You won't be charged if you cancel during the trial. One trial per business.
5. Billing and payments
- Price: $497 per month per business location, plus any applicable taxes.
- Where you pay: on the BackIn60 website, by card, through our payment processor. We don't receive or store your full card number. The app does not sell subscriptions or anything else.
- Renewal: your subscription renews automatically every month, and we charge your card at the start of each monthly period until you cancel.
- Failed payments: if a payment fails, we'll let you know and may pause the service until it's fixed.
- Price changes: we'll give you at least 30 days' notice by email before a price change applies to you.
6. Cancellation and refunds
You can cancel anytime by emailing christeven@mail.tab.bot or through the billing page linked from your account. Cancellation takes effect at the end of your current paid month; you keep access until then and won't be charged again. Except for the guarantee below or where the law requires, payments are non-refundable and we don't give partial-month refunds.
7. The guarantee
If your bookings don't go up in your first paid month compared with the month before you started BackIn60, we'll refund that first month. To claim it, email us within 30 days after that month ends with your booking numbers for both months (for example, from your scheduling system). The guarantee applies once per business, to the first paid month only, and requires that BackIn60 was set up and running (call forwarding on) for that whole month.
8. Your texting responsibilities
You're the sender of the texts that go out from your BackIn60 number, and you agree to follow the laws and rules that apply to texting, including the Telephone Consumer Protection Act, the FCC's rules, state laws and wireless carrier guidelines. In particular, you agree:
- To use BackIn60 to reply to people who called or texted your business, not to send marketing blasts or texts to purchased or scraped lists.
- To keep your business name and “Reply STOP to opt out” (or similar) in the automatic text.
- Not to contact anyone who has opted out. BackIn60 blocks opted-out numbers automatically; don't try to get around it.
- To respect quiet hours and time-of-day rules that apply where your callers are.
- If you're a health-care business, to use BackIn60 for scheduling only, ask patients not to text health details, and not to send health information through BackIn60.
9. Acceptable use
Don't use BackIn60 to send anything illegal, deceptive, harassing or hateful; content about illegal drugs or cannabis, firearms, adult content, gambling or debt collection; phishing or spam; or anything carriers prohibit. Don't break, overload, reverse engineer or resell the service, or use it to violate anyone's privacy or rights. Carriers may block messages that look like spam, and we may block them too.
10. Phone numbers and carrier registration
U.S. carriers require businesses that send texts to be registered. You agree to give us accurate business information for that registration and allow us to submit it for you. Texting may be limited until registration is approved. Your BackIn60 number is assigned for use with your subscription; you don't own it, and it may be released after your account ends. Your own business number stays yours.
11. Your data
Your account content, call logs and messages belong to you (and, for messages, to the people you're talking with). You give us permission to store and process them only to run, secure and improve BackIn60 and as described in the Privacy Policy. You can delete your account at any time in the app or by emailing us.
12. Apple App Store
If you got the BackIn60 app from Apple's App Store: these Terms are between you and BackIn60, not Apple, and BackIn60 (not Apple) is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. BackIn60, not Apple, is responsible for any claims about the app, including product liability, legal compliance and intellectual property claims. You confirm you're not in a country subject to a U.S. government embargo and not on a U.S. government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Disclaimers
BackIn60 is provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Texts and calls travel through carriers we don't control, and we don't promise any message will be delivered, delivered on time, or result in a booking. BackIn60 isn't an emergency service.
14. Limitation of liability
To the extent the law allows, BackIn60 won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers or data. Our total liability for any claim about the service is limited to the amount you paid us in the 3 months before the claim arose.
15. Indemnity
You agree to defend and cover BackIn60 against claims, fines and costs that come from your messages, your breach of these Terms, or your violation of any law or anyone's rights, including texting laws.
16. Suspension and termination
We may suspend or end your account if you break these Terms, if a carrier or the law requires it, or if your use puts the service or others at risk. We'll tell you why when we can. You can stop using BackIn60 and delete your account at any time.
17. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing a claim, please email us so we can try to resolve it informally. Any lawsuit must be brought in the state or federal courts located in New York, and you and we agree to their jurisdiction.
18. Changes to these Terms
We may update these Terms. We'll change the date above, and for significant changes we'll notify you by email or in the app at least 15 days before they apply. If you keep using BackIn60 after that, the new Terms apply.
